High Court Delivers First AI Trademark Ruling

In November 2025 the High Court of England and Wales issued judgment in Getty Images v Stability AI. Mrs Justice Joanna Smith examined claims that the defendant’s Stable Diffusion model infringed the claimant’s registered trademarks by reproducing watermarks within AI-generated images. The court found limited infringement under sections 10(1) and 10(2) of the Trade Marks Act 1994 where identical marks appeared on identical goods or where similar marks on similar goods were likely to cause confusion. The ruling addressed only the trademark elements that proceeded to trial and did not resolve broader copyright issues. It is widely viewed as the first substantial UK decision exploring the application of established trademark law to generative artificial intelligence outputs.
